Brazilian Crypto Exchanges Face Friday Licensing Deadline as Compliance Costs Rise

Brazilian cryptocurrency exchanges are approaching a Friday deadline to apply for authorization under the country’s new regulatory framework, but submitting an application will not complete the process. Firms face substantial capital requirements, detailed compliance duties and potentially lengthy regulatory reviews, while several important questions about implementation remain unanswered.

According to Cointelegraph, exchanges already operating in Brazil must file their applications by Friday if they want to continue serving the market during the review process. Lawyers quoted in the report said the application is only the beginning of a process that may take as long as two years.

What the deadline means for crypto platforms

Companies that submit applications on time can continue operating while the Banco Central do Brasil, Brazil’s central bank, assesses their cases. By contrast, new crypto businesses must obtain authorization before beginning regulated services.

Operators that miss Friday’s cutoff will have to stop providing services within 30 days of the deadline, according to Marcelo de Castro Cunha Filho, a lawyer at Machado Meyer. The restrictions will extend beyond the exchanges themselves. From Nov. 6, banks and payment institutions will also be restricted from handling crypto transactions with providers that are not authorized.

The rules are part of Brazil’s crypto regulatory framework introduced in November 2025. The framework places exchanges, custodians and other virtual asset service providers under central-bank supervision.

Fabio Cendão, founding partner at Brazilian law firm FCM Law, described the filing as the easiest stage of the process. He pointed to the financial requirements, complex compliance obligations and recurring audits that applicants will face after submitting their paperwork.

Brazil’s importance to the industry makes the deadline particularly significant. Chainalysis recorded $252.5 billion in crypto activity in the country between July 2025 and June 2026, making Brazil the world’s leading country for grassroots crypto adoption by that measure.

Uncertainty over transfers and self-custody

The regulatory framework requires crypto service providers to verify the origin and destination of transfers. That obligation also covers transactions involving self-custodial wallets, where customers hold their private keys rather than using a wallet controlled by an exchange or another service provider.

The rules also set a $100,000 limit for certain international crypto transfers when the counterparty is not authorized to operate in Brazil’s foreign-exchange market. However, industry participants say the practical interpretation of these requirements is not yet clear.

Thiago Sarandy, Binance Brazil’s general manager, identified questions about how exchanges should recognize self-custody wallets, apply the $100,000 operational limit and determine the minimum threshold for reporting transactions. He said the industry association ABCripto had sent questions to the central bank but had not received answers.

Sarandy warned that unclear requirements could lead exchanges to submit fragmented or inconsistent information to regulators. In his view, that could weaken the authorities’ ability to monitor the market effectively.

Another unresolved issue concerns customers of businesses that fail to meet the deadline. Cunha Filho said it remains unclear how such exchanges should return crypto to customers who do not have accounts with authorized providers or who have not agreed to move their assets.

The Banco Central do Brasil had not responded to Cointelegraph’s request for comment by the time of publication.

Smaller exchanges face a heavier burden

Several large international platforms have applied, including OKX, Binance and Coinbase. At the same time, Latin American exchange Bitso is ending its direct retail services in Brazil through a partnership with local platform Mercado Bitcoin.

The cost of meeting the new requirements may be more difficult for smaller operators. Cendão said minimum capital requirements range from 10.8 million Brazilian reais, or about $2 million, to 37.2 million reais, depending on the services a company plans to provide.

Applicants must also address technical certification, custody audits and anti-money-laundering controls. Those expenses could make continued compliance impractical for some smaller exchanges, Cendão said, raising the possibility of greater concentration among larger firms.

The immediate effect of the deadline will therefore depend not only on which companies submit applications, but also on whether they can sustain the financial and operational demands that follow. Until regulators clarify the outstanding questions, exchanges must prepare for a regime whose requirements are extensive but whose application in several areas remains uncertain.
