Crypto Groups Seek Fast Court Ruling on Illinois Digital-Asset Tax

Crypto advocacy groups are asking an Illinois court to accelerate a decision on a lawsuit challenging the state’s 0.2% digital-asset tax. Enforcement has been delayed until July 2027, but the groups want the law’s legality determined before the pause ends.

Crypto Groups Seek Fast Court Ruling on Illinois Digital-Asset Tax

Illinois’ planned tax on digital-asset transactions is facing a broader legal challenge after two major crypto industry groups joined an effort to secure a fast court ruling on whether the measure is lawful. The tax has already been delayed for six months, but its opponents want the underlying case decided before enforcement begins.

Industry groups ask court to move quickly

The Crypto Council for Innovation (CCI) and the Blockchain Association said they would join the Digital Chamber and the Illinois Blockchain Association in seeking a ruling on the merits of lawsuits challenging the tax. According to Cointelegraph, the groups made the request in a Tuesday filing with the Circuit Court of Sangamon County.

The filing asks the court to approve an expedited schedule for summary judgment. Summary judgment allows a court to decide a case based on the legal arguments and evidence presented when there is no need for a full trial on disputed facts. The organizations said a quicker process would enable the court to determine the tax’s legality as soon as possible.

CCI and the Blockchain Association are pursuing one lawsuit against Illinois state officials, while the Digital Chamber and Illinois Blockchain Association filed a separate case. The groups are seeking to coordinate their efforts around the legal questions raised by the legislation.

Six-month pause delays enforcement

Illinois officials earlier agreed to postpone implementation of the Digital Asset Tax Act from Jan. 1 to July 1, 2027. The measure imposes a 0.2% tax on crypto assets.

The delay was reached in connection with the Digital Chamber’s lawsuit. Opponents argue that the tax was inserted into the state budget without sufficient debate or an opportunity for public feedback. The temporary pause means Illinois consumers and businesses will not face enforcement of the measure before July 1, although the law itself remains under challenge.

CCI CEO Ji Kim said pausing enforcement protects consumers and businesses in the interim, but argued that the court should still resolve the central legal dispute promptly. The proposed schedule, if approved, could lead to a decision on the merits by March.

Digital Chamber CEO Cody Carbone previously said his organization would continue its legal proceedings until the tax was permanently overturned. The court has yet to approve the expedited timetable.

Leadership transition at Blockchain Association

The legal push comes as the Blockchain Association prepares for a change in leadership. CEO Summer Mersinger is scheduled to leave the role on Friday as part of a transition. Mersinger joined the group last year after resigning from the US Commodity Futures Trading Commission.

Kristin Smith, the association’s former CEO, is expected to become interim head. Mersinger is expected to remain with the organization through the end of 2026.
