ESMA gives EU crypto firms until January 2027 to address non-compliant stablecoins

The European Securities and Markets Authority has told crypto-asset service providers in the European Union to stop offering services connected with stablecoins that do not comply with the bloc’s Markets in Crypto-Assets Regulation, or MiCA.

According to Cointelegraph, ESMA said national regulators should require firms to deal with their remaining exposure to unauthorised stablecoins as soon as possible and no later than January 8, 2027. The instruction gives companies three months to address existing client positions and related services.

What ESMA’s guidance requires

The guidance applies to crypto-asset service providers authorised under MiCA. ESMA said these firms should cease providing services involving stablecoins that are not compliant with the European regulatory framework when those services are offered to clients in the EU.

The covered activities include:

  • Trading-platform services and crypto exchange services
  • Order execution, custody and transfers
  • Investment advice and portfolio management

Stablecoins are crypto-assets designed to maintain a stable value, commonly by being linked to an asset or reference value. Under ESMA’s guidance, firms must distinguish between stablecoins that meet MiCA requirements and those that are not authorised under the framework.

ESMA also said firms should put technical, contractual and organisational controls in place. The purpose of those controls is to prevent EU clients from acquiring additional exposure to non-compliant stablecoins or increasing positions they already hold.

Limited exit services may remain available

The guidance does not necessarily require an immediate end to every activity involving an existing position. National regulators may allow firms to provide limited services that help clients exit those positions.

Potentially permitted activities include liquidation, conversion, withdrawal, transfers and safekeeping. ESMA stressed that these services should be temporary and subject to close supervision. The stated purpose is to enable clients to reduce or remove their exposure while preventing firms from continuing ordinary services involving the unauthorised stablecoins.

The deadline for addressing remaining exposure is January 8, 2027. ESMA’s latest update expands on guidance issued in January 2025, which called for restrictions on trading and exchange services involving stablecoins that did not comply with MiCA.
